Terms of Service

1. Agreement to Terms

By accessing or using the SPXXL platform at spxxl.com (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service. SPXXL reserves the right to modify these Terms at any time.

2. Description of Service

SPXXL provides a market session classification engine and analytical tools for SPX and 0DTE options trading. The Service includes real-time session scoring, chart overlays, historical analysis, strategy projections, and related educational content. SPXXL is an analytical and informational tool only — it does not execute trades, provide investment advice, or manage money on your behalf.

3. Not Financial Advice

SPXXL does not provide financial, investment, tax, or legal advice. All data, session classifications, confidence scores, strategy suggestions, close-zone projections, and any other output from the platform are for informational and educational purposes only. They should not be construed as recommendations to buy, sell, or hold any security or financial instrument.

Options trading — especially 0DTE options — involves substantial risk of loss and is not suitable for all investors. You should consult a licensed financial advisor before making any trading decisions. Past performance and historical data displayed on SPXXL do not guarantee future results.

4. User Accounts

• You must provide accurate, current, and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to create an account.
• One account per person. Sharing accounts is prohibited.
• You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions & Payments

FREE Trial

New users receive a FREE trading week (5 market sessions). Weekends and market holidays do not count against the trial. No credit card is required to start.

0DTE Special Pass

A single-day pass providing full access for one trading session. The pass activates at the next market open if purchased outside market hours. Weekends do not count against the pass duration.

Elite Monthly

A recurring monthly subscription billed via Stripe. You may cancel at any time through your account page or the Stripe billing portal. Cancellation takes effect at the end of the current billing period.

Refunds

Due to the nature of digital services, all sales are final. Refund requests may be considered on a case-by-case basis at our sole discretion. Contact [email protected] for any billing disputes.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or use automated tools to extract data from the platform
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Redistribute, resell, or publicly share proprietary SPXXL data, classifications, or analytics
• Interfere with, disrupt, or overload the Service infrastructure
• Impersonate any person or misrepresent your affiliation
• Share your account credentials or allow others to access your account

7. Intellectual Property

All content on SPXXL — including but not limited to the scoring engine algorithms, session classification logic, chart overlays, UI design, text, graphics, logos, and software — is the property of SPXXL and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, SPXXL and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, trading losses, data loss, or goodwill — arising out of or related to your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to SPXXL in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data and classifications will be accurate or timely.

10. Assumption of Risk

You acknowledge that trading options, particularly 0DTE options, carries a high degree of risk. You use SPXXL at your own risk and accept full responsibility for any trading decisions and their financial outcomes. SPXXL shall not be held liable for any trading losses.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability and intellectual property) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
